NACC Participates in the 14th United Nations Expert Group Meeting on Anti-Corruption
The National Anti-Corruption Commission Thailand (NACC) continues its commitment to elevate Thailand's anti-corruption initiatives to the global stage by attending the 14th Session of the United Nations Implementation Review Group on Anti-Corruption.
The Thai delegation comprises Cheewin Na Talang, the Chargé d'Affaires ad interim at the Embassy in Vienna, Suwit Sawangthong, Deputy Attorney General, along with the International Affairs and Corruption Investigation Bureau of the NACC (Thailand). They are participating in the resumed 14th Session of the Implementation Review Group (IRG) held in Vienna, Austria.
On the first day of the meeting, August 4th, 2023, the Chargé d'Affaires at the Embassy in Vienna delivered a National Statement, reporting on the developments of Thailand's anti-corruption initiatives as an evaluated State Party, based on recommendations from the UNODC (United Nations Office on Drugs and Crime) under the UNCAC (United Nations Convention against Corruption) assessment mechanism.
The NACC, acting as the central agency for Thailand, expressed its steadfast commitment to advancing laws, measures, and practices, especially in the area of international cooperation and asset recovery, in line with the obligations of the United Nations Convention against Corruption.
As for The United Nations Convention against Corruption (UNCAC), serves as the first international law addressing anti-corruption on a global scale, with its obligations divided into three levels:
1) mandatory obligations for State Parties;
2) optional clauses that State Parties may or may not adopt; and
3) clauses that State Parties should consider.
The main content of the UNCAC is divided into five categories: Prevention of Corruption, Criminalization and Law Enforcement, International Cooperation, Asset Recovery, and Technical Assistance and Information Exchange. Currently, there are 187 State Parties, including 27 from Western Europe, 23 from Eastern Europe, 29 from Latin America and the Caribbean, 53 from Africa, and 55 from Asia. Representatives from the European Union also participate in every session. Thailand has been a signatory to the UNCAC since December 9th, 2003, and ratified it on March 1st, 2011.
The international meeting under the UNCAC convenes periodically to enhance the capabilities of member states and foster international collaboration in combating corruption. This consists of:
1.) The "Working Group on Prevention" allows participants to exchange information and experiences on current state party actions against corruption, as well as recommendations received from the UNCAC State Party meetings.
2.) The "Working Group on Asset Recovery" aims to facilitate information sharing, best practices, and promote international cooperation between requesting and requested states for asset recovery.
3.) The "Expert Meeting on International Cooperation" focuses on enhancing collaboration to build capabilities according to the needs of the state parties.
4.) The "Implementation Review Group" (IRG) tracks the progress of state parties in complying with UNCAC agreements through specific review mechanisms.
The review mechanism of UNCAC compliance has a system to evaluate the performance of state parties. This is done through a randomized selection of reviewing and reviewed states, administered by the United Nations Office on Drugs and Crime (UNODC). Each evaluation cycle lasts six years. The first cycle, spanning 2010–2015, focused on "Criminalization and Law Enforcement" and "International Cooperation." The second cycle, from 2016–2021, evaluated "Preventive Measures" and "Asset Recovery."
