Examining the progress in the case of the government transition from Prime Minister Prayut to Prime Minister Srettha, the National Anti-Corruption Commission (NACC) proceeds with opening for the submission of assets and liabilities declarations from political office holders. The deadline is set for 60 days following the assumption of office.
Niwatchai Kasemmongkol, the NACC Secretary-General and Spokesperson, disclosed that in line with the announcement from the Election Commission (EC) that all 500 members of the House of Representatives have been verified, including 400 constituency MPs and 100 party-list MPs. Under the Constitutional Act on the 2018 Prevention and Suppression of Corruption, Article 102 specifies that political office holders must submit declarations of their assets and liabilities, as well as those of their spouses and children who have not reached legal adulthood. The NACC has announced the criteria and procedures for submission to the Commission.
Most recently, the NACC office has designated the public disclosure of assets and liabilities of political office holders and individuals in independent organizations. There are 53 names on the list available for review at the exhibit room on the 1st floor of the Sanambin Nam NACC office. The disclosure period is from September 15th to October 14th, 2023.
The NACC prepares to launch an online platform for local administrative organization personnel to declare their assets, in accordance with Section 102 (9). The platform will be available from October 1st, 2023 onward.
Secretary-General Niwatchai further stated that in the case of the transition of the government, for the Prime Minister and Ministers, the day they take the oath of office is considered the day of assumption of their roles. For Members of the House of Representatives, it is the day they take their oath in the Parliamentary session. Submissions must be made within 60 days from the date of taking office. However, if there is a necessity, an extension of no more than 30 days can be requested by explaining the reason for the delay to the NACC and submitting the request before the deadline.
Thus, following the swearing-in ceremony of Prime Minister and ministers in the government of Srettha Thavisin on September 5, 2023, according to the Constitution of the Kingdom of Thailand, Buddhist Era 2560, it resulted in the end of the duties of Prime Minister and ministers in the government of General Prayut Chan-o-cha. The NACC Office has therefore clarified the details for the submission of asset and liability accounts along with supporting documents for both parties, as follows:
1.) The Prime Minister and ministers in the government of General Prayut Chan-o-cha are required to submit an account of assets and liabilities, along with supporting documents, to the NACC committee, upon leaving the position as of September 5, 2023. The deadline for this submission is within 60 days, from September 6 to November 4, 2023. If they cannot submit within the given timeframe, they can request an extension not exceeding 30 days, and this must be filed by November 4, 2023.
2.) The Prime Minister and ministers in the government of Srettha Thavisin are required to submit an account of assets and liabilities, along with supporting documents, to the NACC committee upon taking office as of September 5, 2023. The deadline for this submission is within 60 days, from September 6 to November 4, 2023. If they cannot submit within the given timeframe, they can request an extension not exceeding 30 days, and this must be filed by November 4, 2023.
Furthermore, if any minister in the government of General Prayut Chan-o-cha is appointed as a minister in the government of Srettha Thavisin within 30 days after leaving the former position, they will be exempted from having to submit asset and liability accounts when leaving the old position and taking on the new one. This exemption also applies in the case where someone holds the position of a member of the House of Representatives and is appointed to another ministerial position. For those who held local executive or council positions and are appointed as ministers in the government of Mr. Srettha Thavisin, they must submit asset and liability accounts upon leaving their local positions as per section 102 (9) and upon taking on the ministerial position as per section 102 (1).
When submitting an asset and liability account to the NACC, it must be accompanied by supporting documents, which serve as evidence to prove the existence of the assets and liabilities. This also includes evidence of personal income tax paid in the previous tax year. If submitting in paper form, the submitter must sign to certify the accuracy on the asset and liability account and on every page of the supporting documents submitted. Along with this, a detailed list of the accompanying documents for the asset and liability account must be prepared. There are three methods to submit the asset and liability account, which are:
1.) Direct submission or delegated to another individual to submit at the central NACC office or at the provincial NACC office.
2.) Send it via registered mail with acknowledgment of receipt.
3.) Submit the asset and liability account online through the ODS system, which is convenient and quick. Simply prepare files and supporting documents in PDF format and submit them through the website https://asset.nacc.go.th.
