NACC indicts former Chantaburi MP Thanaphat Kittiwongsa for illegally possessing land in Khao Soi Dao Wildlife Sanctuary
On January 21, 2026, Mr. Surapong Intarathaworn, Secretary-General of the National Anti-Corruption Commission (NACC), as the NACC spokesperson, announced that the NACC has resolved to find Pol Lt Col Thanaphat Kittiwongsa guilty of illegally possessing three plots of land totaling 94-1-59 rai within the Khao Soi Dao Wildlife Sanctuary in Chanthaburi Province while serving as a Member of Parliament for Chanthaburi.
The investigation revealed that in 2014, Pol Lt Col Thanaphat purchased three plots of land totaling 94-1-59 rai in Patong and Thap Chang subdistricts, Soi Dao District, Chanthaburi Province, from the previous occupants. This land is located within the Khao Soi Dao Wildlife Sanctuary, Chanthaburi Province, as per the Revolutionary Council Announcement No. 200 dated August 26, 1972. He subsequently took possession of the land, cultivating longan orchards and constructing a house, and personally applied for the address.
Following his election as a Member of Parliament for Chanthaburi Province on March 24, 2019, Pol Lt Col Thanaphat continued to occupy and utilise the land within the wildlife sanctuary and submitted his asset declaration to the NACC upon assuming office, claiming that the three plots of land without title deeds were a property of his spouse.
Subsequently, when the land ownership survey team conducted a survey of land ownership by residents in the Khao Soi Dao Wildlife Sanctuary on May 11, 2020, Pol Lt Col Thanaphat had his son present himself as the owner and user of the land, even though he was well aware that he, his spouse, and his son were not persons authorized or permitted to reside or cultivate the land according to the law. This is because they were not the original occupants and continuous users of the land as surveyed and registered by the Royal Forest Department of according to the Cabinet resolution of June 30, 1998, nor were they legal heirs of the original land occupants, since the land cannot be bought or sold, nor were they considered impoverished, low-income, or landless according to the National Council for Peace and Order Order No. 66/2014 dated June 17, 2014.
The actions of Pol Lt Col Thanaphat, in his capacity as a Member of Parliament and appointed commissioner in the Special Committee on Land Issues and Land Title Issuance, where he illegally occupied and utilised state land in a protected forest area reserved for the country's natural resources, constitute dishonest performance of duty. This is an act of seeking undue advantage for himself or others without regard for the national interest, and it is an act that damages the dignity of the position of Member of Parliament.
The NACC has considered the matter and passed the following resolution:
The actions of Pol Lt Col Thanaphat Kittiwongsa constitute a serious violation or non-compliance with ethical standards, according to the ethical standards of Constitutional Court judges and those holding positions in independent organisations, including the Auditor General and heads of the administrative units of the Constitutional Court and independent organizations, B.E. 2561, Sections 7, 8, and 17, in conjunction with Sections 3 and 27, paragraphs one and two,
The matter, based on the aforementioned offenses, shall be submitted to the Supreme Court for adjudication, in accordance with Section 87 of the Organic Act on Prevention and Suppression of Corruption, B.E. 2561.
